As outlined by the EPA in their article, “Learn the Basics of Hazardous Waste,” hazardous waste is any material with properties that pose risks to human health or the environment. These materials, generated from sources like industrial processes and everyday items such as batteries, may take the form of solids, liquids, gases, or sludges.
The hazardous waste identification process begins by determining if the material qualifies as a solid waste under the Resource Conservation and Recovery Act (RCRA) Subtitle C. Once classified as a solid waste, further investigation determines if the material is specifically excluded from regulation. If not, the waste is assessed to determine whether it meets the listed or characteristic hazardous waste criteria set by the EPA. Facilities may also petition the EPA to “delist” certain wastes from regulation under RCRA Subtitle C.
This systematic approach ensures hazardous materials are appropriately identified and regulated, minimizing their potential harmful impact on health and the environment.
